The expungement process isn't easy, particularly if you are trying to expunge a felony (in most cases expunging a misdemeanor is easier). If you are currently going through this process you should talk to a qualified expungement lawyer - they will be able to give you the best advice considering the facts of your case.

There are a lot of misunderstandings about how expungement works. First of all, these decisions are all made at the state level - it is incorrect to make a blanket statement that you cannot expunge a felony in the US. Some states, such as Utah, allow felonies to be expunged (as long as they do not deal with sexual abuse of minors and are not certain aggravated classes), while Florida is more strict and only allows for expungement when somebody is acquited of a crime.

Why expungements are good
California has friendly expungement laws. While on the face this might seem to be bad for society, it is actually a great benefit to tax payers. When people are able to expunge their records and move on with their life they are more likely to get a real job, stop committing crimes and be a functioning member of society.

When states don't allow any convictions to be expunged many 1-time offenders are put in positions where they must work lower paying jobs (if they are able to find jobs at all). Most people agree that a single charge such as a DUI from 20 years ago shouldn't affect your ability to find employment today.

Sorry I misspelled that they said I COULDN'T GET THOSE 2 CHARGES EXPUNGED THE RECKLESS ENDANGERMENT AND LEAVING SCENE OF ACCIDENT.

Yes I had a bad check charge and I forgot my court date then 3 and half years ago I accidentally hit a vehicle and left the scene of accident and i was upset and didnt mean to hit vehicle. they arrested me on bad check i spent 72 hours in jail for check and now a misdimeanor for the 2 charges reckless endangerment and leaving scene of accident . They said I could get it expunged because of the previous conviction of bad check. I really need it expunged bad its really hurt me with getting a good job and im by myself and have to support myself. please help me if you can . Thank you this was in the state of tn.

My stepson is doing time in federal prison. He has a probation violation pending . Will they let him do state and federal probation together? will they make him do more time?

I was had a felony expunged from my record 9 years ago in Louisiana. I was arrested for theft. I have a live scan scheduled in 2 days in Texas for a teaching position. They are going to run my prints through NCIS as well. Will my expunged record show up on the live scan?

I too was convicted of a feony 10 years ago, then I had an expungement in 2008- I want to get a government job- however I am afraid of what to put on my application---please tell me how your live scan worked for you and what you had to disclose---I hope you got the job :)

The Federal Law holds more weight that individual state laws. Under the Federal Law, those convicted of a felony can not possess guns. Period. The only way around the Federal law is an exemption from the Feds who do not recognize expungements for weapons possession.
